By accessing, browsing, or using ChessPuzzles.ai (the "Service," "Platform," "Website," or "we," "us," "our"), you ("User," "you," "your") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms," "Agreement") in their entirety. If you do not agree to all terms and conditions of this Agreement, you must immediately discontinue use of the Service.

YOUR USE OF THE SERVICE CONSTITUTES YOUR BINDING ACCEPTANCE OF THESE TERMS, INCLUDING ANY FUTURE MODIFICATIONS. We reserve the right to modify, amend, or update these Terms at any time, at our sole discretion, without prior notice. Continued use of the Service following any such changes constitutes your acceptance of the revised Terms.

ChessPuzzles.ai provides chess game analysis, puzzle generation, and related features. The Service utilizes chess engine software and algorithms to analyze chess games and generate training content.

No Warranties:The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of the Service, the accuracy, completeness, reliability, suitability, or availability of any content, information, or features provided through the Service.

You acknowledge and agree that all service parameters, including but not limited to:

• Engine Analysis Depth:Any stated analysis depth (e.g., "depth 6," "depth 12," "depth 20") represents a target configuration only. Actual analysis depth may vary based on system load, computational resources, time constraints, position complexity, and other factors at our sole discretion.
• Analysis Duration and Resources: Time allocated per move, per game, or per analysis session is determined solely by us and may be adjusted without notice.
• Game Limits:Daily, monthly, or total game analysis limits are subject to change at our discretion. "Games per day" or similar limits represent maximum allowances, not guaranteed minimums.
• Feature Access:"Full access," "premium access," "all filters," "all categories," and similar descriptions are relative terms that may be limited, modified, or redefined at any time.
• Filters and Categories: The availability, categorization, and functionality of all filters, categories, difficulty levels, and sorting mechanisms are determined exclusively by us.
• Puzzle Quality and Quantity: The number of puzzles generated, their difficulty, categorization, and quality are algorithmic outputs that we do not guarantee.

WE RESERVE THE ABSOLUTE RIGHT TO MODIFY, LIMIT, RESTRICT, OR DISCONTINUE ANY SERVICE FEATURE, PARAMETER, OR FUNCTIONALITY AT ANY TIME WITHOUT PRIOR NOTICE OR LIABILITY.

4.1 Payment Terms

All fees and charges are due in advance and are non-refundable. By subscribing to or purchasing any paid features, you authorize us to charge your designated payment method.

4.2 AI Explanation Credits

Subscribers receive 5 free AI move explanation credits per calendar month. Additional credits may be purchased as one-time add-ons ("Purchased Credits"). Regarding Purchased Credits:

• Purchased Credits do not expire under normal use and carry over between months.
• Purchased Credits are non-refundable once purchased.
• Purchased Credits are tied to your account and cannot be transferred, gifted, or resold.
• Free monthly credits that go unused do not roll over and carry no monetary value.
• Right to Modify or Expire Credits: ChessPuzzles.ai reserves the right to modify, expire, adjust the value of, or discontinue Purchased Credits at any time with reasonable notice. This includes, but is not limited to, changes due to repricing, cost structure changes, model provider changes, or discontinuation of the explanation feature.
• In the event of credit expiration or value adjustment, ChessPuzzles.ai will make reasonable efforts to provide advance notice via email or in-app notification.

4.3 AI-Generated Content Disclaimer

Move explanations are generated by third-party AI language models. By purchasing or using explanation credits, you acknowledge and agree:

• ChessPuzzles.ai makes no guarantees regarding the accuracy, completeness, quality, or usefulness of AI-generated explanations.
• Explanations are provided for educational and entertainment purposes only and do not constitute professional chess coaching or authoritative analysis.
• The AI model, provider, and quality of output may change at any time without notice. ChessPuzzles.ai is not obligated to use any specific AI model, provider, or configuration. We may substitute models of varying capability at our sole discretion.
• AI-generated content may contain errors, inaccuracies, or hallucinated information. Users should verify important chess analysis independently.
• The purchase of credits does not create any obligation for ChessPuzzles.ai to maintain a particular level of AI output quality, speed, or availability.

4.4 No Refunds Policy

ALL SALES ARE FINAL. WE DO NOT OFFER REFUNDS, CREDITS, OR EXCHANGES FOR ANY SUBSCRIPTION FEES, PURCHASED CREDITS, OR OTHER PAYMENTS MADE TO US, REGARDLESS OF USAGE, SATISFACTION, OR CIRCUMSTANCES.

This includes, but is not limited to: partial subscription periods, unused daily game quota, unused Purchased Credits, dissatisfaction with AI output quality, technical issues, account termination, or service modifications.

4.5 Subscription Modifications

We reserve the right to change subscription pricing, features, limits, and terms at any time. Such changes may apply to existing subscriptions upon renewal.

4.6 Free Tier

Any free tier, trial, or promotional offering is provided at our sole discretion and may be modified, limited, or terminated at any time without notice. Free tier limitations and features are not guaranteed.

We reserve the absolute right to suspend, restrict, limit, or terminate your account and access to the Service at any time, for any reason or no reason, with or without notice, at our sole discretion.

Reasons for termination may include, but are not limited to:

• Violation or suspected violation of these Terms
• Abuse of the Service or system resources
• Fraudulent, deceptive, or harmful conduct
• Automated access, scraping, or data harvesting
• Sharing account credentials
• Any conduct we deem harmful to the Service, other users, or third parties
• Any other reason at our absolute discretion

UPON TERMINATION, YOU FORFEIT ALL RIGHTS TO ANY PAID SUBSCRIPTION PERIODS, CREDITS, OR OTHER PURCHASED FEATURES. NO REFUNDS WILL BE PROVIDED FOR TERMINATED ACCOUNTS.

6.1 Data We Collect

By using the Service, you consent to our collection, storage, processing, and use of all data associated with your use of the Service, including but not limited to:

• Account information (email addresses, usernames, authentication data)
• Chess platform usernames and associated public game data
• All chess games analyzed through the Service
• Generated puzzles, analysis results, and training data
• Usage patterns, preferences, and interaction data
• Device information, IP addresses, and technical identifiers
• Payment and billing information
• Any other information you provide or that is generated through your use

6.2 Data Usage Rights

YOU GRANT US A PERPETUAL, IRREVOCABLE, WORLDWIDE, ROYALTY-FREE, FULLY TRANSFERABLE LICENSE TO USE, REPRODUCE, MODIFY, ADAPT, PUBLISH, TRANSLATE, CREATE DERIVATIVE WORKS FROM, DISTRIBUTE, DISPLAY, AND OTHERWISE EXPLOIT ALL DATA COLLECTED THROUGH YOUR USE OF THE SERVICE FOR ANY PURPOSE, INCLUDING BUT NOT LIMITED TO:

• Service operation, improvement, and development
• Research, analytics, and statistical analysis
• Machine learning and AI training
• Marketing and promotional purposes
• Sale, licensing, or sharing with third parties
• Any other commercial or non-commercial purpose

6.3 Data Retention

We retain your data for as long as necessary to provide the Service and fulfill the purposes described herein. We may retain data after account termination for legal compliance, fraud prevention, analytics, dispute resolution, and enforcement of our agreements. Aggregated or de-identified data may be retained indefinitely.

Users in certain jurisdictions may have statutory rights regarding their data. Where legally required, we will process valid requests subject to identity verification and applicable legal exceptions.

6.4 Third-Party Sharing

We may share your data with third parties, including service providers, business partners, advertisers, and acquirers, without restriction. We are not responsible for third-party data practices.

All content, features, and functionality of the Service, including but not limited to software, algorithms, analysis methods, puzzle generation techniques, user interface, design elements, text, graphics, and logos, are owned by us or our licensors and are protected by intellectual property laws.

User-Generated Content: Any content you submit, including chess games for analysis, becomes our property upon submission. You warrant that you have the right to submit such content and grant us all rights described herein.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHESSPUZZLES.AI, ITS OWNERS, OPERATORS, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or goodwill
• Service interruptions or downtime
• Inaccurate analysis, puzzles, or recommendations
• Chess performance or rating changes
• Loss of access to content or features
• Security breaches or unauthorized access
• Any other damages arising from use of or inability to use the Service

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TEN DOLLARS ($10), WHICHEVER IS LESS.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your requirements or expectations
• The Service will be uninterrupted, timely, secure, or error-free
• Analysis results, puzzles, or recommendations will be accurate or beneficial
• Using the Service will improve your chess skills or rating
• Any errors in the Service will be corrected
• The Service will be compatible with your systems or devices

You agree to indemnify, defend, and hold harmless ChessPuzzles.ai, its owners, operators, affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of or access to the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or share through the Service
• Any activity under your account

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

ANY DISPUTE ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING ARBITRATION IN ACCORDANCE WITH THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement: These Terms constitute the entire agreement between you and ChessPuzzles.ai regarding the Service and supersede all prior agreements and understandings.

Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Assignment: We may assign our rights and obligations under these Terms without restriction. You may not assign your rights or obligations without our prior written consent.

Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
